THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Chapter 17-1400 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 17-1400. NON-COMPETITIVELY BID CONTRACTS; FINANCIAL ASSISTANCE

§ 17-1406. Sole Source Contracts, Exigency and Other Exceptions.

(5)

The provisions of subsections 17-1402(1)(a) and (1)(c) shall not apply to:

(b) Non-Competitively Bid Contracts in an amount less than the amount set forth in subsection 8-200(2.1)(a) of the Charter (relating to

small business and

local business contracts), as such amount is adjusted from time to time, provided that:

(.1) The contract is awarded to a Local Business Entity

or Small Business Entity

(as

those terms are

[that term is] used in Section 17-109).

SECTION 2. Section 1

shall be effective upon certification of the election in which voters approve of the question placed on the ballot by Ordinance No. 260xxx.
