THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Title 9 of The Philadelphia Code is hereby amended to read:

§9-647. Sale of Foie Gras Prohibited.
(1)
No person or establishment shall sell foie gras within the City of Philadelphia.
(2) For purposes of this section:
(a)
“Foie gras” means any food containing the liver of a bird, which has been enlarged beyond normal size through forced feeding.
(b)
A “bird” means any member of the avian family, including but not limited to a duck or goose.
(c)
“Forced feeding” means causing a bird to ingest an excessive quantity of food, or more food than a typical bird of the same species would consume voluntarily while foraging. Force feeding methods include, but are not limited to, delivering feed through a tube or other device inserted into the bird’s esophagus.
(3)
The Department may only issue a warning in response to any first violation of this section. Subsequent violations of this section are “Class II” offenses subject to the penalties provided in §1-109.
SECTION 2. This Ordinance shall take effect ninety (90) days after it becomes law.
