Amending Chapter 12-3400 of The Philadelphia Code, entitled “Use of an Automated Speed Enforcement System to Improve Safety,” to reduce fines for automated speed enforcement violations based on the amount by which a vehicle exceeds the posted speed limit; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS

:

SECTION 1. Chapter 12-3400 of the Philadelphia Code is hereby amended to read as follows:

§ 12-3406. Fines and penalties.

(1) Fines for a violation under this Chapter are as follows:

(a) When the vehicle exceeds the posted speed limit by 11 miles per hour or more, but by less than 20 miles per hour, [one hundred dollars ($100)]

fifty dollars ($50)

(b) When the vehicle exceeds the posted speed limit by 20 miles per hour or more, but by less than 30 miles per hour, [one hundred twenty-five dollars ($125)]

seventy-five dollars ($75)

.

(c) When the vehicle exceeds the posted speed limit by 30 miles per hour or more, [one hundred fifty dollars ($150)]

one hundred dollars ($100)

.

SECTION 2. This Ordinance shall take effect thirty (30) days after it becomes law and shall apply to violations occurring on or after that date. Violations occurring before that date shall remain subject to the fines applicable when they occurred. Nothing in this Ordinance shall cancel or modify a fine or additional penalty imposed for a violation occurring before its effective date.
