Full text

WHEREAS, Certain businesses and commercial establishments may, depending on their operations and surrounding circumstances, generate recurring quality-of-life, public safety, health, or nuisance concerns in Philadelphia neighborhoods; and

WHEREAS, Community members have raised concerns regarding the concentration and operation of certain nuisance businesses in particular neighborhoods and have requested greater transparency regarding how complaints are received, investigated, and addressed; and

WHEREAS, The Department of Licenses and Inspections (“L&I”), the Philadelphia Department of Public Health, and other City departments and agencies have various authorities to inspect establishments, enforce applicable laws and regulations, and, where authorized by law, suspend or revoke licenses or take other enforcement action; and

WHEREAS, City Council seeks to better understand how those enforcement authorities are currently implemented, including the circumstances under which establishments may be cited, fined, closed, or otherwise subject to enforcement action; and

WHEREAS, Community members and business owners have requested greater clarity regarding the City's enforcement processes, including how complaints are investigated, how enforcement decisions are made, and what factors may result in immediate or expedited action; and

WHEREAS, Council seeks to examine whether current enforcement practices are being applied consistently across neighborhoods and whether additional resources, clearer procedures, or legislative changes are necessary to address chronic nuisance violations while protecting the due process rights of businesses and individuals; and

WHEREAS, Council further seeks to examine potential policies addressing establishments with repeated or chronic violations, including whether additional enforcement tools, conditions on license renewal, or other legally permissible remedies could improve compliance and protect the health, safety, and quality of life of Philadelphia residents; and

WHEREAS, Philadelphia's requirements governing commercial signage are intended to promote clear and accurate information, appropriate neighborhood design, and public safety. This hearing will evaluate the implementation and enforcement of existing signage requirements, including whether business names, descriptions, and signage accurately and transparently reflect the primary goods or services offered by an establishment; and

WHEREAS, The City's regulations governing window signs and coverings are intended to balance the interests of businesses in advertising their goods, services, hours, and promotions with the City's interest in maintaining appropriate design standards and visibility into and out of commercial establishments. This hearing will examine the implementation and effectiveness of those requirements and the impact of signage and window coverings on neighborhood appearance, pedestrian visibility, and public safety; and

WHEREAS, The Committee on Licenses and Inspections is well-positioned to examine the City's current enforcement practices, implementation strategies, costs, interdepartmental coordination, community engagement, and potential legislative or administrative changes related to nuisance businesses, signage, and window coverings; now, therefore, be it

RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That the Committee on Licenses and Inspections is hereby authorized to hold hearings to examine the implementation and enforcement of laws and regulations relating to nuisance businesses, including Stop and Go establishments, signage, and window coverings, and to examine the effectiveness, consistency, transparency, and community impact of current enforcement practices.
