Authorizing the Commissioner of Parks and Recreation, on behalf of the City of Philadelphia, to enter into a multiyear agreement with Broad Street Love Park, LLC for the design, construction, management and operation of a food and beverage concession at the Welcome Center Building (“Saucer”) in Love Park, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1.

The Commissioner of Parks and Recreation is hereby authorized, on behalf of the City of Philadelphia, to enter into a multiyear agreement with Broad Street Love Park, LLC for the design, construction, management and operation of a food and beverage concession at the Welcome Center Building (“Saucer”) in Love Park, which terms must be substantially consistent with those set forth in the term sheet attached to this Ordinance as

SECTION 2.

The City Solicitor is hereby authorized to review and approve the multiyear agreement authorized by this Ordinance, which multiyear agreement shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interests of the City of Philadelphia and carry out the purpose of this Ordinance.

EXHIBIT “A”

Terms of Proposed Multiyear Agreement

For Design, Construction, Management and Operation of a Food and Beverage Concession: The Saucer in Love Park

1.

Concessionaire:

Broad Street Love Park, LLC.

2.

Licensed Area:

The Welcome Center Building (“Saucer”) or portions thereof.

3.

Purpose:

Design, Construction, Management and Operation of a Food and Beverage Concession at the Saucer.

4.

Commencement Date:

June 29, 2026

5.

Term:

The Initial Term of the Agreement shall be for five (5) years; the City may exercise the option to renew the Term with an additional five (year) Renewal Term.

6.

Termination:

The City has the right to terminate after four (4) years without cost or penalty to the City at any time after the expiration of the fourth year following the Commencement Date.

7.

Concession Fee:

Concessionaire to pay annual Concession Fee pursuant to the Agreement.

8.

No Financial Obligation for City

. The City has no financial obligation under the Concession Agreement.

9.

Capital Improvements:

Concessionaire to develop a permanent concept with full meal table and bar service by engaging professional services (such as architects and engineers), contractors and subcontractors to complete the fit-out of The Saucer.

10.

Equal Economic Opportunity:

In accordance with an executed Antidiscrimination Policy attached to the Agreement.
