The enacted bill expands Philadelphia’s rules for selling spray paint and indelible markers to also cover etching acid, defined as substances that can etch, carve, engrave, or damage glass or metal. Retail businesses selling these products must have a Department of Licenses and Inspections license, keep them secured or out of public view, and generally may not sell them to minors unless a parent or legal guardian is present. For certain violations, the Department may confiscate the products, and the reclaiming fee is increased from $200 to $300.

Amending Title 9 of The Philadelphia Code, entitled "Regulation of Businesses, Trades and Professions" by amending the provisions of Section 9-618 relating to the "Sale of Spray Paint Containers and Indelible Markers" to include the sale of Etching Acid and to make certain technical changes.
