This enacted law amended Philadelphia retirement rules for members of Plans D, J, and X who have a dependent child who remains dependent because of a physical or mental disability. It allows the member to direct survivor benefits to an irrevocable trust for that child, provided the trust meets specified requirements, including being valid under Pennsylvania law and being submitted to the Pension Board within 30 days.
Amending Chapter 22-300 of The Philadelphia Code, entitled "Retirement Benefits," by amending Section 22-306, entitled "Retirement and Survivorship Benefit Options," by providing for benefits to be paid to certain trusts for disabled children, under certain terms and conditions.
