This enacted law allows a judge to issue a warrant to temporarily remove firearms from a person when a Commonwealth attorney or two police officers provide probable cause that the person poses an imminent risk of injury to themselves or others and possesses firearms in Philadelphia. The Court of Common Pleas must hold a hearing within seven days to decide whether the firearms should be returned or held, and the Philadelphia Police Department may retain them for up to one year under the law; eligible recipients may also receive transferred firearms under applicable law.
Amending Chapter 10-800 of The Philadelphia Code, entitled "Safety," by adding a new Section, entitled "Temporary Removal of Firearms of Persons Posing a Risk of Imminent Personal Injury to Self or Others."
