This enacted measure amended Philadelphia’s Clean Indoor Air Worker Protection Law to let qualifying private clubs apply for a temporary waiver from the city’s indoor smoking ban, with applications due by June 30, 2010. The waiver required conditions including approval by the club’s board or members and at least two-thirds of its employees, along with compliance with city licenses, taxes, and other requirements.

Amending Section 10-602 of The Philadelphia Code, known as the "Clean Indoor Air Worker Protection Law," by providing a limited period of time, expiring June 30, 2010, during which a Private Club, as defined, may apply for and obtain a waiver of the provisions of the Section prohibiting smoking in certain places, under certain terms and conditions.
