The enacted ordinance legalizes Mark Sherman’s existing raised concrete patio at 3749-51 Midvale Avenue, which extends about eight feet into the west footway of Midvale Avenue. The owner must obtain required permits and approvals, enter into an agreement with the City, maintain required insurance or equivalent coverage, and remove the patio if the City provides notice for a municipal construction project or otherwise requires its removal.
