The enacted measure creates Philadelphia rules for third-party food delivery services, including requiring them to disclose commissions charged to restaurants and obtain consent before using a restaurant’s name or trademarks in advertising. During declared public health emergencies and for 90 days afterward, it limits certain fees charged to restaurants, bars delivery fees above 10% of an order’s purchase price, and prohibits reducing delivery-driver pay or tips because of those limits.

Amending Title 9 of The Philadelphia Code to create a new Chapter 9-5000, entitled "Food Delivery Services," to regulate third-party food delivery services, require certain disclosures to consumers, and provide for a limitation on certain fees charged to consumers; all under certain terms and conditions.
