This enacted ordinance changes Philadelphia’s rules for fees that third-party food delivery services charge food service establishments. It limits delivery fees to 10% of an online order and other fees to 5%, while allowing establishments to agree to higher fees for additional services under certain conditions. The rules apply during certain declared public health emergencies and to agreements entered into, renewed, extended, or amended after November 30, 2021; violations can result in fines, and delivery services may not reduce drivers’ compensation or withhold gratuities because of the limits.
Amending Chapter 9-5100 of The Philadelphia Code, entitled "Food Delivery Services," to modify the limitation on fees charged to food service establishments; all under certain terms and conditions.
