The enacted ordinance prohibits using City-owned or controlled property and Philadelphia public rights-of-way as staging areas, processing locations, or operation bases for civil immigration enforcement, with exceptions for existing leases and lawful judicial warrants or criminal-law enforcement. It requires City agencies to create procedures and notify officials about violations, and allows affected individuals or entities to seek civil remedies, including damages, attorney fees, fines, and certain contract penalties; it takes effect 60 days after becoming law.
Amending Title 10 of The Philadelphia Code, entitled "Regulation of Individual Conduct and Activity," and amending Title 11 of The Philadelphia Code, entitled "Streets," to prohibit immigration enforcement on City and City-related property and facilities, to prohibit immigration enforcement in the right-of-way and provide for civil enforcement of violations, all under certain terms and conditions.
