Full Bill

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. The Commissioner of Public Property, on behalf of the City of Philadelphia, is authorized to lease for nominal consideration from The School District of Philadelphia certain property located in the vicinity of Byberry and Academy Roads as more fully described on Exhibit 1 ("Property") for a term of ten (10) years ("Lease").

SECTION 2. The Commissioner of Public Property, on behalf of the City of Philadelphia, is authorized to sublease the Property for nominal consideration to the Academy Sports Association for a term of ten (10) years for use as ball fields and to provide athletic and recreational activities for members of the community ("Sublease").

SECTION 3. The City Solicitor is authorized to include in the Lease and Sublease such terms and conditions as in the opinion of the City Solicitor shall be necessary and proper to protect the interests of the City.

SECTION 4. The Chief Clerk of City Council shall keep on file all exhibits referenced in this Ordinance and shall make them available for inspection by the public during regular office hours.

"EXHIBIT 1"

PARCEL "A"

ALL THAT CERTAIN lot or piece of ground with the buildings and improvements thereon erected situate in the City of Philadelphia described in accordance with a plan made February 9, 1983 by John Reilly, Surveyor and Regulator of the Fourth Survey District as follows:

BEGINNING at an interior point, said interior point being measured the three (3) following courses and distances from the point of intersection of the northeasterly side of Byberry road (sixty-four feet wide) and the southeasterly side of Academy road (eighty feet wide); thence extending (1) north sixty degrees three minutes thirty-six seconds east along the said southeasterly side of Academy road the distance of two hundred sixty-eight feet two and five-eighths inches to a point of curve; (2) thence ex-tending northeastwardly and southeastwardly along the southeasterly and southwesterly side of said Academy road along an arc of a circle curving to the right having a radius of one thousand three hundred forty-six feet one and one-quarter inches the distance of one thousand two hundred thirty-two feet two and three-quarters inches to a point; (3) thence extending south twenty-nine degrees fifty-one minutes twenty-five seconds west the distance of four hundred two feet two and three-eighths inches to the interior point of beginning; thence extending south sixty degrees twenty-five minutes twenty seconds east the distance of four hundred sixty feet eleven and one-quarter inches to a point; thence south fifty-one degrees four minutes twenty seconds west the distance of one thousand sixty-four feet three and three-quarters inches to a point; thence -north thirty-six degrees forty-five minutes twenty-five seconds west crossing the head of a certain proposed twenty feet wide easement the distance of four hundred sixty-three feet and one-eighth inches to a point; thence extending north fifty degrees twenty-eight minutes thirty-five seconds east the distance of seven hundred fourteen feet six and five-eighths inches to a point; thence extending south sixty degrees eight minutes thirty-five seconds east the distance of ninety-seven feet six and five-eighths inches to a point; thence extending north twenty-nine degrees fifty-one minutes twenty-five seconds east the distance of one hundred thirty-seven feet four and one-half inches to the first mentioned point and place of beginning.

CONTAINING in area 10.1067 acres.

PARCEL "B"

All that certain lot or piece of ground situate in the 66th. Ward of the City of Philadelphia and described in accordance with a Plan of Property (V44-812) made by Barry Slepion, Surveyor and Regulator of the Fourth Survey District, dated April 22, 2002 as follows to wit:

Beginning at a point on the Northeasterly side of Byberry Road (64' Wide) at the distance of 481.296' Southeastwardly from the Southeasterly side of Academy Road (80' Wide - S.R.1013);

Thence extending N 50?-52'-53" E, the distance of 728.056' to a point;

Thence extending S 60?-08'-35" E, the distance of 416.662' to a point;

Thence extending S 50?-28'-35" W, the distance of 714.621' to a point;

Thence extending S 36?-45'-25" E, partly crossing a 20' wide Easement, the distance of 463.010' to a point on the Northwesterly side of a certain 24.750' Wide Lane;

Thence extending S 51?-04'-20" W, along the Northwesterly side of the aforementioned Lane, the distance of 250.724' to a point on the Northeasterly side of the aforementioned Lane;

Thence extending N 43?-11'-35" W, along the Northeasterly side of the aforementioned Lane also partly through the bed of the aforementioned Easement, the distance of 565.098' to a point on the Northeasterly side of the said Byberry Road;

Thence extending the following two (2) courses and distances along the Northeasterly side of the said Byberry Road;

1) Northwestwardly, on the arc of a circle curving to the left, having the radius of 564.000' and the arc distance of 171.510' to a point of tangency;

2) N16?-56'-24" W, the distance of 157.095' to the first mentioned point and place of beginning.

Containing in area 476.053.0 square feet or 10.92867 acres.
