Amending Chapter 10-600 of The Philadelphia Code, entitled "Public Places - Prohibited Conduct," by amending Section 10-611, entitled "Sidewalk Behavior," by amending the process to be followed prior to taking coercive action for violations of the Section, under certain terms and conditions.
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Section 10-611 of The Philadelphia Code is hereby amended to read as follows:
§10-611. Sidewalk Behavior.

(7) Enforcement.
(a) [No]
Except as set forth in §10-611(7)(e), no
law enforcement officer shall issue a notice of violation or take any coercive action against any person in violation of this Section, unless, prior to issuing such notice or taking such action, the officer or his or her designated representative:

(e) The provisions of §10-611(7)(a) shall not apply to disorderly conduct in violation of 18 Pa. C.S. § 5503.

SECTION 2. This Ordinance shall take effect immediately.
