Amending Section 5 of an Ordinance (Bill No. 110436) approved June 23, 2011, entitled "An Ordinance authorizing Kimmel Center, Inc., 200 South Broad Street, Philadelphia, Pennsylvania, owner of the Kimmel Center located at 300 South Broad Street, to construct, own and maintain various encroachments in the right-of-way on the south sidewalk of Spruce Street between Broad and Fifteenth Streets, under certain terms and conditions," by extending the period for compliance with the terms and conditions therein.
WHEREAS, An Ordinance (Bill No. 110436) approved June 23, 2011, was conditional upon certain requirements being complied with within one (1) year from the data of approval; and
WHEREAS, It is desirable to extend the timeframe within which such conditions may be met; now, therefore
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Section 5 of an Ordinance (Bill No. 110436) approved June 23, 2011, is hereby amended to read as follows:
SECTION 5. The permission granted to Kimmel Center, Inc. to construct, own and maintain the encroachments described in Section 1 shall expire without any further action by the City of Philadelphia if Kimmel Center, Inc. has not entered into an Agreement and satisfied all requirements of the Agreement that are listed in Section 4 of this Ordinance [within one (1) year after this Ordinance becomes law]
by August 9, 2013.
SECTION 2. This Ordinance shall not become effective unless the sum of two hundred dollars ($200.00), toward costs thereof, is paid into the City Treasury within sixty (60) days after the date this Ordinance becomes law.
