Full Bill

WHEREAS, The City of Philadelphia and certain airlines providing regularly scheduled service to Philadelphia International Airport desire to enter into Agreements memorializing their respective rights and responsibilities and to establish a methodology for the rates and charges imposed at the Airport; now, therefore

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. The Department of Commerce, on behalf of the City of Philadelphia, is hereby authorized to enter into and execute a certain Use & Lease Agreement (Agreement) in substantially the form of

“Exhibit A” hereto

with each Airline providing regular scheduled service to Philadelphia International Airport, or which shall in the future provide such regularly scheduled service, that agrees to meet the terms and conditions contained therein.

SECTION 2. The Airlines shall have the use and occupancy of the space as set forth in the Exhibits to the Agreement and the Airlines shall pay the rents, rates, charges, for such space and at such times, in accordance with the formulae and in the manner set forth in the Agreement.

SECTION 3. The requirements of Philadelphia Code Section 18-201(8) are deemed to be satisfied fully by the inclusion of Section 16.16 in the Agreement, and no additional language regarding the subject of Philadelphia Code Section 18-201(8) need be included in such Agreement.

SECTION 4. The Department of Commerce is authorized to takes all further actions as may be necessary in order to accomplish the intent and purposed of this Ordinance.

SECTION 5. The City Solicitor is hereby authorized to include in the Agreement such other terms and provisions as she shall deem necessary or appropriate to protect the interests of the City.

SECTION 6. The Chief Clerk of City Council shall keep on file the document referred to as Exhibit “A” and shall make it available for inspection by the public during regular office hours.
