THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

(1) Definitions. For the purpose of this Chapter, a public bathing place shall mean an outdoor or indoor place lawfully held out to the public for the purpose of swimming or bathing whether or not a fee is charged for admission or for the use of the place, including, but not limited to, those within multi-family housing complexes, hotels, and private clubs.
(2) Notice requirement. No person shall own or operate a public bathing place without providing lifeguard service at any time such public bathing place is open or accessible to the public or residents unless a warning sign appears in plain view inside the pool area which states in clearly legible lettering at least 1 inch in height: "WARNING - NO LIFEGUARD ON DUTY." Such warning signs shall also state in clearly legible lettering at least 1 inch in height "NON-SWIMMERS AND CHILDREN UNDER 14 YEARS OF AGE NEED RESPONSIBLE ADULT SUPERVISION."
(3) Remedies Not Excluded.
(a) Nothing in this Section shall relieve the owner or operator of public bathing places of responsibility or liability for any accidents or injuries occurring on or around such facilities.
(b) Nothing in this Section shall relieve the owner or operator of a public bathing place of his or her obligations under the Public Bathing Law, Act of Jun. 23, 1931, P.L. 899, No. 299.
