THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
Exhibit A
Shared Use Trail Maintenance Agreement for Use and Maintenance of Girard Avenue and Interstate 95 Interchange Trail.
1. Term: To run from the effective date of the agreement until terminated by either party. The Commonwealth may terminate the agreement at any time upon ninety (90) days written notice to the City. The City may terminate the agreement at any time after four (4) years with no financial obligation or penalty upon thirty (30) days written notice to Commonwealth.
2. Location: Girard Avenue and Interstate 95 Interchange.
3. PennDOT's obligations: Construct Shared Use Trail to serve very limited motorized vehicles for emergency and maintenance purposes. Trail shall be constructed by PennDOT and is owned by the Commonwealth of Pennsylvania.
4. City's Financial obligations: City, by and through its Department of Parks and Recreation, shall provide maintenance for the Trail for at least 4 years.
5. Purpose: The Trail would connect the East Coast Greenway and the Port Richmond Trail, connect the local community from Richmond Street and Allegheny Avenue to the Delaware River and allow for recreational use by pedestrian and limited non-motorized traffic, including bicycles, strollers, skateboards, skates, and roller bladers.
