Amending Title 4 of The Philadelphia Code (The Philadelphia Building Construction and Occupancy Code), Subcode PM (The Philadelphia Property Maintenance Code), by adding requirements regarding the use of dumpsters on private property; and amending Section 10-722 of the Code, entitled "Use of Dumpsters," to make conforming changes; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 4 of The Philadelphia Code is hereby amended to read as follows:

PM-308.4 Dumpster Enclosures. A dumpster, as defined in Section 10-722 of this Code (“Use of Dumpsters”), that is stored out-of-doors, but not in the public right-of-way, shall be maintained within an enclosure to conceal the dumpster from view from the right-of-way. A

dumpster enclosure may be an opaque fence, a shrubbery fence, or an enclosed structure. Any structure built after the effective date of this provision for use as an enclosure for a dumpster shall comply with the requirements of Subcode B of Title 4, The Philadelphia Building Code, and Title 14, The Zoning Code.

SECTION 2. Section 10-722 of The Philadelphia Code is hereby amended to read as follows:

SECTION 3. The Regulations of the Department of Licenses and Inspections relating to Sections 9-604 and 10-722 of The Philaelphia Code, filed with the Department of Records on March 1, 1990, are hereby abrogated.

SECTION 4. This Ordinance shall be effective immediately.
