Amending Title 11 of The Philadelphia Code, entitled "Streets," by amending Chapter 11-600, entitled "Construction, Encroachments And Projections Over, On And Under Streets," by amending Section 11-608, entitled "Excavation and Construction In and Under the Sidewalks," by providing that areaway encroachments may extend into the street line as far as may be required by the applicable utility provider.
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Title 11 of The Philadelphia Code is hereby amended to read as follows:
TITLE 11. STREETS.

CHAPTER 11-600. CONSTRUCTION, ENCROACHMENTS AND PROJECTIONS OVER, ON AND UNDER STREETS.

§ 11-608. Excavation and Construction In and Under the Sidewalks.

(1) Areaways. No areaway shall be constructed unless:
(a) A building permit has been obtained;
(b) It is covered with fixed iron gratings and is not enclosed by a railing;
(c) It does not project beyond the street line more than one-quarter of the width of the sidewalk, nor more than 3 feet in any case, provided that notwithstanding any restriction in this § 11-608(1) (c), an areaway may extend as far beyond the street line as may be required in order to comply with the applicable utility provider's requirements.
SECTION 2. This Ordinance shall be effective immediately.
