THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Section 9-207 of The Philadelphia Code is hereby amended to read as follows:

§ 9-207. Motor Vehicle [Repairs]

Repair, Sale or Temporary Placement on City Streets

.

(1) Prohibitive Conduct. No person who owns, operates or controls or who is employed in the business of repairing motor vehicles shall use any portion of City sidewalks or streets

, including parking spaces,

for the repair

, sale or temporary placement

of motor vehicles.

The prohibitions of this Section apply whether or not the person engaged in such conduct is lawfully authorized or licensed to repair vehicles.

(2)

Exemptions. The provisions of this Section shall not apply to emergency road service performed more than 500 feet from premises used for the repair of motor vehicles.

(3) Penalty. The penalty for violation of this Section shall be a fine of [fifty dollars ($50)]

three hundred dollars ($300) per vehicle, per day
