THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Section 9-205 of The Philadelphia Code is hereby amended to read as follows:

§ 9-205. Sidewalk Sales.

(1) Definitions. In this Section, the following definitions apply:

(c) Sidewalk. All that area legally open to the public use as a pedestrian public way between the curb line and the legal building line of the abutting [property.]

(2) Exemptions. The provisions of this Section do not apply to:

(h) Vending on the sidewalk on or adjacent to any City park, playground, or recreation center under the jurisdiction or management of the Department of Parks and Recreation, which is prohibited unless approved by a permit issued by the Department of Parks & Recreation.
