Authorizing acceptance of the grant to the City of two certain areas located on either side of Hunting Park Avenue, east of Whitaker Avenue, as slope easements, under certain terms and conditions.
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. The Streets Commissioner, on behalf of the City of Philadelphia, is hereby authorized to accept the grant to the City of two certain areas, located on either side of Hunting Park Avenue and extending from a point approximately three-hundred forty-five feet east of Whitaker Avenue to a point approximately one-hundred eighty-six feet further eastwardly therefrom, as slope easements for the purpose of supporting and protecting the area within the bed of said Hunting Park Avenue, including the placement and maintenance of drainage facilities to protect the highway. Acquisition by the City of property as slope easements shall not prevent the property owner from making any use of the areas covered by the slope easements so long as that use is not detrimental to the support of the highway or the safety of the traveling public.
SECTION 2. The said areas to be acquired as slope easements under authority of Section 1 are delineated in Exhibit “A” attached hereto. Exhibit “A” to this Ordinance shall be kept on file by the Chief Clerk and shall be available for public inspection.
SECTION 3. The City Solicitor is hereby authorized to review and approve all instruments and documents necessary to effectuate this Ordinance, which instruments and documents shall contain such terms and conditions as the City Solicitor shall deem necessary or appropriate to protect the interests of the City.
