Full Bill

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. The Commissioner of Public Property is hereby authorized to enter into a lease agreement between the City of Philadelphia, as landlord, and the Holmesburg Fish and Game Protective Association, Inc., as tenant, for use of all or a portion of City property bounded by the Pennypack Creek, the Delaware River, Pennypack Street, and State Road in Philadelphia, Pennsylvania, pursuant to terms substantially set forth in

Exhibit “A”.

SECTION 2. The City Solicitor is hereby authorized to review and to approve the lease agreement and all instruments and documents necessary and helpful to effectuate this Ordinance, and to include in the lease agreement and all other instruments and documents all terms and conditions the City Solicitor deems necessary, proper, and desirable to promote and protect the interests of the City and to carry out the purpose of this Ordinance.

EXHIBIT “A”

Terms of Proposed Lease Agreement

1. Landlord:

City of Philadelphia through its Department of Public Property (“City”)

2. Tenant:

Holmesburg Fish and Game Protective Association, Inc. (“HFG”)

3. Premises:

A portion of City property bounded by the Pennypack Creek, the Delaware River, Pennypack Street, and State Road.

4. Use of the Premises:

The facility shall be used for recreational and training purposes, including indoor and outdoor firing ranges and for HFG’s administrative offices.

5. Term of Lease:

Initial Term of ten (10) years.

6. Renewal Term:

City has the options to renew for two (2) successive five (5) year terms.

7. Rent:

Base rent is $1 for each lease year of the Initial Term and the Renewal Terms, if exercised.

8. Utilities:

The City is responsible for all utilities.

9. Maintenance Expenses:

HFG is responsible for all maintenance expenses.
